THE VOTIQUE – TERMS OF USE

Welcome to The Votique — your go-to stage for fan-powered recognition and interactive event voting. Before jumping into our platform, here’s what you need to know. These Terms of Use govern your experience on The Votique. By using the platform, you’re agreeing to all the terms below.

1. GENERAL GUIDELINES

• You must be 13 years old or above to register and participate.
• Keep your submissions and interactions respectful — no harmful, illegal, explicit, or offensive content is allowed.
• One person = one account. Do not create multiple accounts to enter voting or contest-based campaigns.
• Don’t share or sell your login credentials or account. Be responsible for what happens on your profile.
• Only authorized partners may manage accounts on behalf of others.
• The information you provide must be truthful and updated regularly.
• You agree to comply with all local laws when using our services.
• The Votique reserves the right to restrict or terminate access if rules are broken or abuse is detected.

2. PLATFORM USAGE

We’re constantly enhancing The Votique — this means features may be modified, suspended, or removed without prior notice.

Advertising may appear on the platform from time to time. These may be personalized based on your interactions, activities, or content. By continuing to use The Votique, you acknowledge and accept the presence of such promotions.

3. YOUR CONTENT & OUR RIGHTS

You retain full ownership of the content (photos, captions, etc.) you upload to The Votique. However, by uploading, you grant us a non-exclusive, royalty-free, global license to showcase, promote, and use your content on our platform and channels to enhance the user experience.

You also agree:

• That you have the rights to use and publish the content you post.
• That your content doesn’t infringe on any third-party rights.
• To bear any legal responsibility for content-related fees or claims.
• That we may use engagement data (likes, shares, comments, votes) to improve platform visibility and performance.

Note: The Votique logo, brand name, and design are our intellectual property. Please don’t reproduce or alter them without prior consent.

4. VOTING EVENTS & FEATURED CAMPAIGNS

• If your entry wins, the campaign host will be granted a non-exclusive, royalty-free right to use the winning submission for marketing or promotional purposes.
• Winners may be selected based on:
  1. Public Support (highest number of votes)
  2. Random Draw (from eligible submissions)
  3. Organizer’s Choice (manual selection by host)
• Hosts cannot change the winner selection method once the campaign begins.
• Submissions may be displayed on external sites, event backdrops, or brand media.
• Campaign organizers may offer to purchase full media rights of a submission at a flat rate of USD $15 per item, subject to your approval. The rights only transfer once you agree.
• The Votique will retain a 25% facilitation fee on each completed sale.

Organizers can revise campaign details while it is live, but any cancellation requires approval from The Votique support team.

5. PAYMENTS & PURCHASES

Some features and access levels require payment. These are clearly indicated within the platform.

• All charges must be paid in full at the time of purchase, including any applicable recurring subscriptions.
• Payments are processed securely through trusted third-party platforms (e.g., Stripe or other gateways). You agree to their terms and ours.
• Except where specifically stated, all payments are final and non-refundable.

6. INTELLECTUAL PROPERTY & COMPLIANCE

Respect others’ rights just as you expect yours to be respected.

You may not:

• Post copyrighted materials you don’t have rights to.
• Use bots, automated tools, or scrapers on the platform.
• Harvest user data or spam other participants.
• Access private areas of the site or servers without authorization.
• Violate any laws, regulations, or event rules.

Repeat infringers may have their accounts suspended or permanently removed.

7. RESPONSIBILITY & LEGAL COVERAGE

You agree to indemnify and hold harmless The Votique and its team from any losses, liabilities, or legal actions resulting from your actions on the platform or content you’ve submitted.

8. LIMITATION OF LIABILITY

In the event of a dispute or issue:

• The Votique’s total liability will not exceed USD $60 or the amount paid by you, whichever is less.
• We are not liable for any indirect, incidental, or consequential damages, including lost data, income, or reputation.

9. REFUND POLICY

We do not offer refunds for successful payments unless your case qualifies under our payment partner’s policy. If a payment is processed outside the valid transaction time, the gateway provider will issue a refund. The Votique is not responsible for refunds under those conditions.

10. DATA & PRIVACY

Your trust is important to us. Please see our Privacy Policy for details on how your personal data is collected, stored, and used.

11. ACCOUNT TERMINATIONY

If you breach any of the above terms, we may suspend, restrict, or terminate your access to The Votique without prior notice.
